    • Meta Pixel: We incorporate “pixels” provided by Meta Platforms, Inc. on our Websites. This enables us to track user behavior.   • Embedded Scripts: An embedded script is a programming code designed to collect information about your interactions with the Service. It is temporarily downloaded onto your computer from Annie's' web server, or from a third party with which Annie's works, and is active only while you are connected to the Service and deleted or deactivated thereafter.
  • Device Recognition Technologies: Technologies, including those that apply statistical probability to data sets, as well those that link a common unique identifier to different device use (e.g., social media profile ID), which attempt to recognize or make assumptions about users and devices (e.g., that a user of multiple devices is the same user or household).
  • Session Replay: We capture how you use and interact with a Website or the Service through behavioral metrics, heatmaps (which show where Website visitors click or spend time), and session replay (which let us watch how visitors use our Website in real-time) to improve and market our products/services. Website usage data is captured using first and third-party cookies and other tracking technologies to determine the popularity of products/services and online activity. For example, Cheetah Digital helps us send emails, PayPal and Paymentech help us process online payments, and Strategic Fulfillment Group helps with orders. Shopper Approved helps us gather reviews about our website and products.

Additionally, the Service may offer you the option to send a communication to a friend or other contact. You may only send such communications to people who have given you permission to do so. The recipient's personal information that you provide (e.g., name, email address) will be used to facilitate communication. Your contact information and message may be included in the communication.

Changing Personal Information

We may not be able to delete your personal information except by also deleting your user account. Annie's is not responsible for the content or privacy practices of any linked websites that we do not control. 

 

State Specific Privacy Rights Policy

State consumer privacy laws may provide their residents with additional rights regarding our use of their personal information. 

  • U.S. states including California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Montana, Oregon, Tennessee, Texas, Utah, and Virginia provide (now or in the future) their state residents with rights to: Confirm whether we process their personal information;. 
  • Access and delete certain personal information; 
  • Correct inaccuracies in personal information; 
  • Data portability; 
  • Either limit (opt-out of) or require consent to process sensitive personal information; or

This does not apply to the disclosure of a record or information that has been aggregated in a way that does not reveal personally identifiable information. Exercising Your Rights to Know or Delete

To exercise your rights to access, know, or delete described above, please submit a request:    

Only you, or someone legally authorized to act on your behalf, may make a request to know or delete any information related to your personal information. 

You may also make a request to know or delete it on behalf of your child. 

You may only submit a request to know twice within a 12-month period. Your request must: 

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative, which may include:
    • Matching three data points provided by the consumer to data points maintained by the business.
    • A signed declaration under penalty of perjury verifying the requestor’s identity.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.  

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.   

You do not need to create an account with us to submit a request to know or delete. However, we do consider requests made through your password protected account sufficiently verified when the request relates to personal information associated with that specific account.  

We will only use personal information provided in the request to verify the requestor's identity or authority to make it.   

 

Right to Delete – Account Deletion Notice

Please note that exercising a right to delete your information will also delete your Annie’s account, and any information or products associated with your account. This includes Bookshelf content associated with your account. Response Timing and Format

We will acknowledge your request within ten (10) days of receipt. We endeavor to substantively respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to another 45 days), we will inform you of the reason and extension period in writing.  

If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option. 

Any disclosures we provide will only cover the 12-month period preceding our receipt of your request. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.  

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.   

 

Right to Appeal 

You have the right to appeal a denial of your rights request by following the instructions provided in a denial of request. To appeal a denial of your rights request, follow the instructions provided to you within the denial communication. 

 

Non-Discrimination 

We will not discriminate against you for exercising any of your rights. Unless permitted by law, we will not: 

  • Deny you goods or services; 
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties;  
  • Provide you a different level or quality of goods or services; or  
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services. 

 

Information for Users Outside the United States 

If you are visiting the Service from outside the United States, please be aware that the Service is meant for visitors located in the United States and any information we collect will be transferred to and stored on our servers in the United States.
